H-1B1 is a working visa for professionals. Examples are engineers, accountants,computer programmers, systems analyst, architectural designer, teachers, graphic designers, business analysts, scientists, acupuncturist, some quality control supervisors, casino pit manager, and others. In general in order to qualify for H-1B1 you must meet three requirements:
- You must have a four year college degree or the equivalent of a college degree. Sometimes people can qualify with only work experience or a combination of work experience and some education. In general, the immigration will accept three years of work experience as one year of college education.
- The job itself must require a college degree.
- The immigration must be convinced that the employer has a need for the job position. For example, while the immigration will approve an accountant to work in an accounting firm or for a medium to large business, the immigration will usually deny a case for an accountant working at a small business.
The first step is to obtain the approval of the Immigration Service. If you are in the U.S. the immigration upon approval will change your status to H-1B1. Premium processing is available. With premium processing the immigration will decide your case within fifteen days. If you wish to travel you must then apply at the U.S. Embassy in your home country.
You will need a copy of your degree and transcript. If a license is required to do the job (for example if you are an attorney) then we will need a copy of your license. We need some documentation regarding the employer but this varies a lot from cases to case.
H-1B1 is normally granted in three year increments. The maximum stay is six years but it is possible to obtain extensions beyond six years under certain conditions.
