E-2 visa is a visa for investors and their employees.
E-2 is valuable way live and work in the U.S.by either buying an existing business or starting a new business. It is one of the most popular visas we handle.
1) Duration: An E-2 status can be extended indefinitely as long as the business is doing well. Other working visas have limits as to the number of times they can be extended.
2) Self-Employment:One big advantage of E-2 is the beneficiary is self-employed. You are not dependent on another person for your immigration status. Also being self-employed you have more potential to make money than other working visas in which you are an employee.
3) Flexibility:With an E-2 visa you come and go if you wish. Many E-2 investors own businesses in the U.S. and in Korea or other countries.
4) Spouse employment:Your spouse is eligible to apply for work authorization. Once granted your spouse can work anywhere.
5)Children's Education: With E-2 your children can go to public school in the U.S.
Our office will guide you through the process. We will review all documents and put together a package to obtain E-2. For investors abroad we can apply at the U.S. Embassy in your home country if you qualify. Investors in the U.S. have a choice of applying in the U.S. for a change of their status to E-2 or if they wish they can return to their home country and apply at the U.S. Embassy.
Investors present in the U.S. normally choose to apply using premium processing. With premium processing the immigration will make a decision on your case within fifteen days.
If you have permanent residency in a third country such as Canada you usually have the option of applying there.
All investors should come to the U.S. to look at the businesses they are considering. We can provide the names of licensed business brokers who can help you find and purchase a business.

We do a large quantity of E-2 cases and all of our cases have been approved.The reasons for our success are:
1) We do a good job of screening the good cases from the bad cases when the client first contacts us. Because we have done a large amount of E-2 cases for a long period of time we have developed a feel for what the Immigration Service is looking for both in terms of what they view as a good case and what they view as a bad case. Because we have a good feel for what will be approved, we are often able to reject cases at the initial interview if the case will ultimately be rejected. This saves our clients time, money and frustration.
2) When we work on the case, attorney Jerry Kaufman, personally goes through every case in detail. While paralegals and other attorneys assist in preparation of the case, attorney Jerry Kaufman analyzes every case. The package submitted to the Immigration Service for E-2 is very thick. Sometimes it is as thick as a phone book. One of the most important aspects of an E-2 case is a detailed cover letter explaining what documents are enclosed, why each document is enclosed, a legal explanation to the immigration officer why the case should be approved, and a reference among 1) each legal requirement, 2) the reason why each requirement has been met and 3) the supporting documents for each requirement. 3) The Immigration officers have their cases reviewed by their superiors from time to time. The Immigration Officers have to be able to justify to their superiors why they approved the case. There are many legal requirements for E-2. If the Officer's superior asks about requirement number one or number two or number eight, the Officer using our cover letter can easily point to the legal reason and the documents that justify approval. We try to make it easy for the Immigration Officer.
4) Because we have been successful and because we handle only legitimate cases, with no fraudulent or made-up documents, we have developed a good reputation.
Over the entire period of Mr. Kaufman's professional career all of his E-2 cases have been approved. Possibly because of our record, we have no shortage of clients. Due to the many inquiries we get from clients and our desire to maintain the highest level of success we are selective in what cases we take.
When a prospective client contacts us in regard to E-2 we evaluate both the client and the business they plan to invest in. If we feel the case can and should be approved, we take the case. If we feel the case will not be approved or is not appropriate we decline representation prior to receiving the attorney's fee.
We interview all potential clients to determine the strength of the case.Both the investor and the business must qualify. In looking at the investor we look at their immigration history, their educational experience, work experience, ability to meet immigration marginality requirements, and the impression they make in an interview. When we look at the business we look their financial history, employment history and potential, and business plan.
The location of the business is not relevant to our determination. While most of our cases are located in Southern California we have handled E-2 cases in many states across the country, The U.S. Embassies abroad apply the same standards to all cases from the U.S. regardless of what state the business is located in. While many investors go to Southern California, New York, San Francisco, and Hawaii, we have successfully handled other E-2 cases for clients in other states such asTennessee, Arizona, and Texas.
